ImmuDyne Awarded Final Judgment Against Biothera and Byron Donzis/PSA Inc.FLORENCE, Ky., March 18, 2008 --ImmuDyne (IMMD), the leading supplier of Yeast Beta Glucan, announced today that a final judgment has been entered against Biopolymer Engineering, Inc. d/b/a Biothera by the 285th Judicial District Court of Bexar County, Texas. In its judgment, the Court declared that ImmuDyne owns United States Patent Nos. 5,223,491, 5,519,009, 5,397,773, 5,702,719 and 5,705,184, Europatent 0500718 B1 and Canadian Patent 2072145. The Court also declared that any prior assignments of these Patents by and among Biopolymer Engineering, Inc. d/b/a Biothera, Byron A. Donzis, PSA, Inc. and Immune Health Systems, Inc. are void.
Biopolymer Engineering, Inc. d/b/a Biothera was ordered to pay ImmuDyne approximately $450,000.00 for its attorneys' fees in defending its ownership of the Patents.
